Sex With an Addict is Rape

Under the American with Disabilities Act (ADA), the disease of addiction qualifies as a disability because it is an impairment that, among other things, substantially limits one or more major life activities. (Section 504 of the Rehabilitation Act, the Americans with Disabilities Act (ADA), and Section 1557 of the Affordable Care Act).

It is, therefore, a crime to have sex with someone who is incapable of consenting to a sexual act due to impairment by, in this case, voluntary use of any drug or intoxicant. It is an  apparent condition of intoxication that should reasonably be known by the one initiating the sexual contact and who is not impaired by voluntary drug use. An example of an "apparent condition" is demonstrated in the video interviews here.

Street level prostitution is known by the street level price range for sexual favors - $20 - $40 - the daily national average. This price range identifies the sex worker as a drug addict. Thus, because an addict meets the definition of a mentally disabled person under the ADA and is therefore, incapable of consenting to a sexual act, street level prostitution is actually a system of rape that is accomplished without force, threat or coercion, making the street level prostitute an unrecognized, victim of  sexual assault.

WHAT CAN BE DONE

We need to raise public awareness by sharing this website via social media.  We need to generate conversation about how men with jobs, reputations, and families are contributing to drug addiction, drug overdoses and drug induced deaths when they give money to (mainly) homeless drug addicts. Broadcasting this message will indirectly reach the ears of those men, to secretly encourage the decision to stop, which in turn causes a reduction in street drug availability.

GIVE TO CFS

The second thing that can be done is either visit our contribution page or gift shop.  Proceeds fund  CFS travels to areas known for prostitution, to "catfish" the men who patronize prostitutes for a face-to-face meeting at "prostitute friendly" hotels/motels. We also communicate wirelessly with men in surrounding areas (Dear John).

CFS is NOT a not-for-profit agency.  Contributions to help CFS further it's mission to reduce drug use and addiction by word of mouth may not be tax deductible.
